Terms of Service

1. Acceptance of Terms

By accessing or using VirtualTour ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

VirtualTour is a platform that allows users to create, manage, and share interactive virtual property tours using panoramic images. The Service includes a web-based dashboard, embeddable tour viewer, analytics, and optional managed service add-on.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Subscription Plans & Billing

VirtualTour offers Free, Pro ($29/month or $290/year), and Enterprise ($99/month or $990/year) plans with varying property and room limits. An optional managed service add-on is available at an additional cost per plan tier.

Paid subscriptions are billed in advance on a monthly or annual basis through Stripe. You may cancel your subscription at any time; access continues until the end of your current billing period. Refunds are not provided for partial billing periods.

We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price changes take effect on their next billing cycle.

5. User Content

You retain ownership of all content you upload to VirtualTour, including panoramic images, floorplans, branding images, and property information ("User Content"). By uploading content, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

You agree that your User Content will not:

• Infringe on any third party's intellectual property rights
• Contain illegal, harmful, or offensive material
• Include personal information of others without their consent
• Contain malware, viruses, or other harmful code

We reserve the right to remove content that violates these terms without prior notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated means to access the Service without our permission
• Resell or redistribute the Service without authorization

7. Managed Service

If you subscribe to the managed service add-on, our team will upload and organize content on your behalf. You are responsible for providing the source material and ensuring you have the right to use it. We will make reasonable efforts to accurately represent your properties but are not liable for any errors in the managed content.

8. Embedded Tours

You may embed published tours on third-party websites using the provided embed code. You are responsible for ensuring that the websites where you embed tours comply with applicable laws and regulations.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

10. Termination

You may close your account at any time. We may suspend or terminate your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy. We will make reasonable efforts to allow you to export your data before deletion.

11. Limitation of Liability

To the maximum extent permitted by law, VirtualTour shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms with a revised date. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.
